It always amazes us how often this question comes up with our clients. They’re trying to make the correct Davis-Bacon wage determination and they inevitably call us, totally confused because they’re not sure where they’re supposed to get the wage determination information. SO, we thought it would be helpful to remind everyone – when it comes to a federally funded prevailing wage public works project, per the GPO website, “it is the responsibility of the federal agency that funds or financially assists Davis-Bacon covered construction projects to ensure that the proper Davis-Bacon wage determination(s) is/are applied to such construction constract(s).”

So, if you are working (or bidding) a federal Davis-Bacon project, there should be no uncertainty about the Davis-Bacon wage determination because the agency conducting the bidding should have given it to! If they haven’t – which is more common than we would like to admit – then simply go back to the agency and ask them for it. Yes, it really is that simple. And no, it really isn’t complicated. BUT, remember, this only applies to federal, Davis-Bacon jobs. In California, as you know from reading our blog post on bid advertisement dates, the rules are very different.
